General Terms and Conditions

These Terms and Conditions govern the relationship between Pixelia Electronics and our customers. Please read them carefully before placing an order with us.

§1 Scope and Contracting Parties

These General Terms and Conditions (hereinafter "GTC") apply to all contracts between Pixelia Electronics, c/ Los Meleros 8, 35340 Valleseco (Spain), hereinafter referred to as "we" or "Pixelia", and our customers ("you" / "Customer") regarding the services we offer.

§2 Services

We offer the following services, among others:

  • Digitization of physical media (video, audio, optical media, data cartridges) including RF capture workflow.
  • Recording of physical media (CD, DVD, USB, audio cassettes, etc.) with customer material.
  • Repair and maintenance of vintage electronics.
  • IT services, smart home installations, video surveillance (custom systems + HomeKit integration).
  • Planning and installation of renewable energy systems.

The exact scope of services is specified in the respective individual quotation.

§3 Conclusion of Contract

A contract is only concluded upon our written or electronic order confirmation after you have expressly accepted our individual quotation. Prior to acceptance, our offers are non-binding.

§4 Prices and Payment Terms

The prices stated in the individual quotation apply. Without exception, the following payment terms apply to our services:

  1. Down Payment: Upon acceptance of the quotation, a down payment of 50 % of the agreed total amount is due. Execution of the service will only begin after receipt of this down payment.
  2. Final Payment: The remaining 50 % of the total amount is due upon completion of the service.
  3. Right of Retention: Access to created digital files will only be granted after full payment (100 %) has been received. Likewise, the (return) shipment of processed goods, backup media, and the originally submitted media will strictly only take place after we have received full payment.

§5 Shipping, Delivery, and Handling of Vintage Media

For orders requiring the shipment of physical media or devices to us:

  1. You bear the risk and costs of the shipping route to us. We strongly recommend insured shipping with tracking.
  2. We treat your submitted items with the utmost care. However, it is expressly pointed out that old media (e.g., magnetic tapes, cassettes) and vintage electronics may have unknown pre-existing damage or structural weaknesses due to their age, chemical degradation, or improper prior storage.
  3. Originals will be returned to you upon your express request (shipping costs at your expense) after completion and full payment, or professionally disposed of. You make this decision when placing the order.

§6 Data Processing and Privacy

We process your personal data only insofar as this is necessary to provide the service. Details can be found in our separate Privacy Policy.

For digitization orders, the digital copies of your content are used exclusively for your order and will be deleted from our production systems after successful delivery. Upon special request, we can keep an encrypted archive backup subject to a separate agreement.

§7 Copyright and Intellectual Property Rights

By placing the order, you guarantee that you hold all necessary copyright and usage rights to the submitted content. Pixelia exclusively digitizes material to which you hold the rights yourself (private copies, own recordings, public-domain material). Copy-protected media (with DRM) will not be extracted. The customer shall indemnify Pixelia against any third-party claims arising from a violation of rights.

§8 Limitation of Liability

  1. We are liable without limitation for intent and gross negligence.
  2. Exclusion for vintage media and electronics: we exclude any liability for damage, data loss, or the total loss of old media that occurs during the normal digitization, playback, or repair process. The physical deterioration of vintage media (e.g., tape snapping, shedding of the magnetic layer) is an inherent risk that the customer fully assumes upon placing the order. Furthermore, we provide no guarantee for the permanent functionality of repaired vintage electronics, as unforeseeable age-related failures of other components can occur at any time.
  3. For slight negligence, we are only liable in the event of a breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. Any further liability is excluded.

§9 Right of Withdrawal for Consumers

Consumers generally have a 14-day right of withdrawal. For services that we begin at your express request before the withdrawal period expires, the right of withdrawal expires upon full provision of the service. For the delivery of digital content, the right of withdrawal expires at the start of execution (e.g., start of digitization), provided you have expressly consented to this in advance.

§10 Final Provisions

Spanish law applies. The exclusive place of jurisdiction for merchants is Las Palmas de Gran Canaria. Should individual provisions be invalid, the remainder of the contract shall remain in effect.
